80-20 Endorses, with reservation, Sen. Kerry & Why

80-20's elected Delegates, composed of 1/3 Republicans, 1/3 Democrats and 1/3 Independents, unanimously voted to "endorse , with reservation, Senator John Kerry for President." Their reasons are seen in the press release appended at the end.

In spirit, the "endorsement with reservation" means the following. 80-20 sends a clear message to all politicians & political parties: "If you want AsAms' votes and money, you need to earn it. No more free lunch."

In pragmatic terms for Asian Americans, the "endorsement with reservation" means the following: 80-20 still STRONGLY recommends that AsAms vote for Kerry. However, the 80-20 National will not be going all out in applying its resources to campaign for Kerry. The National will divert part of its war chest for a lawsuit against the Department of Labor which will better serve our community's interest. However, we'll still be doing a lot for Senator Kerry**.

In summary, 80-20's decision achieves three goals. a) To let President Bush and the Republican Party know that if you don't help us, we don't help you. b) To let Senator Kerry and the Democratic Party know that you had helped us some and we'll help back some. c) To let both parties know that 80-20 has tremendous ability to deliver Asian Am. votes. If the two Parties don't believe it now, on election day they'll find out the 80-20's "endorsement with reservation" would increase Senator Kerry's current 7-point lead to at least 30 among Asian Am. voters. Imagine, what they could have gained, had they earned 80-20's FULL endorsement!

**80-20 National will still focus in a couple of contested states to try to win electoral votes for Senator Kerry. We'll still do TV and newspaper ads. The ads will still be in four languages: English, Korean, Vietnamese & Chinese. However, given the delay of two weeks in getting all such efforts started and the allocation of fewer resources, the amount of the buy and the length of air time will obviously not be as large.

Largest Asian American PAC Endorses, with Reservation,
John Kerry for President


80-20, a National cyberspace organization capable of reaching 70% of Asian American (AsAm) registered voters in 30 hours, announced today, with reservation, to endorse Senator John Kerry for President. This decision was unanimously made by 1/3 Republicans, 1/3 Independents, and 1/3 Democrats, 2 weeks after its Endorsement Convention in San Mateo voted to postpone a decision.

Senator Kerry was given the nod because, in comparison, he and the Democratic party are better than Bush and the Republican Party for the past 4 years. Here are the comparisons:

A) Senators Kerry and Edwards both promised in writing to help AsAms achieve equal opportunity in workplaces through the enforcement of Executive Order 11246, while Mr. Bush did not. http://www.80-20initiative/preselect.html EO 11246 has been enforced to break the glass ceiling for African Americans, women, Latinos, Native Americans, but not for Asian Americans.

B) Kerry & Edwards sided with AsAms in condemning Congressman Howard Coble, Chair, House Subcommittee on Homeland Security. Coble stated in public on Feb. 4, 2003 that internment of Japanese Americans during WWII was for protecting Japanese Ams. AsAms would be most worried by that type of protection should there be a significant conflict between USA and an Asian nation. In contrast, Bush & Cheney were silent. See Kerry and Edward statements:

C) The Democratic Party's position on immigration policy and anti-hate crime policy is better for all minorities including AsAms.

80-20 will divert a part of its election war chest to its pending lawsuit against the Department of Labor for its non-enforcement of Executive Order 11246 for AsAms.

Voter Registration Deadline is Oct. 12 or earlier

The deadline is 10/12 or earlier for most states, e.g. for NJ it is
10/4. So here is the easiest way to register & vote. Or go to

How 80-20 fought for you; S. B. under attacks

Two topics.

[A] 80-20 Fighting For You

80-20's Endorsement Convention (EC) decided to POSTPONE ITS
ENDORSEMENT FOR UP TO 2 WEEKS. See our press release:

Why?

80-20 is neither fowl nor fish. Hence, both "fowl/fish," i.e.
politicians in both GOP/Dem, dislike 80-20. They were
accustomed to eating our lunch (votes and money) free, while 80- 20
wants them to pay with services to our community. They both
would love to make 80-20 look bad to get back to the days of the
"Free Lunch."

Such an occasion came in the 2004 election. Both GOP and
the Dems thought 80-20's strength was in CA only (they didn't
realize how much 80-20 has planned to be effective in the
contested states). Since Bush has given up winning CA, the Bush
camp didn't even bother to send a representative to 80-20's EC.
With that, the Dems probably thought that they've got us. That is,
they thought that 80-20 has no choice but to endorse Kerry. They
sent Congressman Michael Honda who was an hour and 15
minutes late but had warm embraces with many Delegates.

Through those interactions, the Delegates sensed that Kerry's
commitment to advance the rightful concerns of the Asian
American community was insufficient. The delegates voted
overwhelmingly to postpone their endorsement for a Presidential
candidate for up to two weeks. 80-20 shall NOT offer your votes
and money to Kerry/Nader/Bush as free lunch. We are willing to
sacrifice our own interests to fight for you!

[B} S. B. Woo Under attacks, and WHAT S. B. HAS TO SAY.

For those who don't read Chinese, here is a summary. On 9/19, 4 hours before 80-20's scheduled press conference to announce its endorsement decision, the GOP big wigs called a "national" phone conference to denounce Woo, saying :

(1) S. B. has manipulated 80-20 and its Endorsement Convention
to serve Kerry,
(2) 80-20 should not sue the Dept. of Labor, its hurts the
reputation of Elaine Chao.

Surprise! 80-20 didn't endorse Kerry although it didn't know about the attacks. The reporters were all laughing at those GOP big wigs who simply can't conceive that there could be AsAms who place the community interest above partisan interests. Many reporters were also saying why sacrifice the chance of erasing the glass ceiling above 12,000,000 AsAms in order to protect the interest of one person, Elaine Chao? Let the court decide. The
court will be fair! Is someone scared that the truth will come out?

Great News On Three Battle Fronts

(A) Great News On the Legal Front: AsAm Legal Eagles Volunteer Pro Bono Service to 80-20 in its Suit against the Dept. of Labor:

(1) Anthony Ching, the first Solicitor General in Arizona, judge pro tem on the Arizona Court of Appeals (just below the Arizona Supreme Court) and who may also be the first Chinese American to argue cases in the US Supreme Court in Graham v Richardson and Perez v Campbell. He was initially very negative towards the merits of 80-20's suit. However, after finding out where the beef is, he volunteered his service for our community.

(2) Paul Igasaki, who for many years was a member of EEOC (Equal Employment Opportunity Commission) and briefly its Acting Head is interested in strategizing with 80-20. Pro bono?

(3) Thomas Tso, A third year Harvard law student with labor law experience is organizing a team of "AsAm LEGAL EAGLES" for 80-20 as a support team for the lead lawyer and Anthony Ching.

Elaine Chao & AsAm officials' ACCOUNTABILITY to us

One reason the AsAm community is politically weak is that we've
NOT asked for ACCOUNTABILITY from AsAm elected or appointed officials.

Here is what you CAN and CAN'T EXPECT from AsAm officials.

CAN'T EXPECT: To do things that will lead to the DESTRUCTION of
his/her political career, e.g. advocating benefits for AsAms only,
when less than 5% of his/her voters are AsAms or when he/she is an appointed official.
CAN EXPECT: To fight for a project that benefits AsAms ONLY when more than 65% of the votes he/she got in the last election came from AsAms. That is, re-election will not be a problem.

CAN'T EXPECT: To speak out on foreign policy issues, when he/she is not a federal official or a federal official whose duties are domestic.
CAN EXPECT: To speak up on foreign policy that YOU favor, if
he/she is a federal official whose duties include the foreign
policies.

CAN'T EXPECT: To hire exclusively AsAm employees in his/her office.
CAN EXPECT: To hire AsAms that is commensurate to the amount of campaign help (votes & money) received from our community.

CAN'T EXPECT: To serve our community AFTER retirement or defeat. He/She deserves a private life too.
CAN EXPECT: To contribute his/her political know-how once in a while, especially if he/she raised a lot of $$ from us to run a big
race & lost. He/She has some obligation to repay our community.

CAN'T EXPECT: To do favors for YOU.
CAN EXPECT: To stand up for the entire AsAm community,
whenever there is a fight for equal justice & opportunity.

CAN'T EXPECT: To exercise his/her authority to favor AsAms.
CAN EXPECT: To treat AsAms NO WORSE than other Americans.

In that last item, ELAINE CHAO HAS BEEN VERY DISAPPOINTING.

The Labor Department was charged with enforcing EO 11246, a law
that has been used to break the glass ceiling for all Americans except AsAms. She is the Labor Secretary. She is an AsAm. She doesn't risk her political career if she quietly or noisily enforces an EXISTING law in an equitable manner for AsAms. No one in America would expect her to do less. She could NEVER be charged with favoring AsAms ONLY since it has been enforced first for blacks, then for women and then for Hispanics. She must stand up for us. We need to hold her ACCOUNTABLE.

On 9/2 in New York City, Elaine Chao cried before Chinese reporters saying that she has received unfair criticism bur preferred not to answer back. 80-20 shall fight for Elaine Chao against unfair criticism. However, 80-20 wants her to answer 80-20's charge that she, as the Labor Secretary, has NOT enforced EO 11246 for AsAms. Instead of crying and saying that she was proud of her roots, she needs to prove that she treats AsAms NO WORSE than any other Americans.

Suing DOL/Be An Undecided/Big War Chest/ Delegates

1) Filing A Law Suit Against The Department of Labor, DOL:

80-20 is actively preparing to sue The Department of Labor for non-enforcement of Exec. Order 11246 on behalf of AsAms. EO 11246 is a comprehensive and powerful law that broke the glass ceilings for other minorities including the blacks, the women and the Hispanics. It was never enforced for AsAm. See

Such a suit has a legal precedent. The 9th Circuit court, the second highest level of courts of the land, ruled on 12/4/1979 in favor of an almost identical case. The Legal Aid Society of Alameda County filed a suit against then Labor Secretary Peter Brennan for non-enforce of EO 11246 in a number of agricultural companies. The Secretary was ordered by the court to enforce the law, and the federal contracts held by offending companies were terminated. For those of you with law training, see 608 F.2d 1319, West Law.

"The National Review" Featured 80-20

80-20 got a lot of press notice lately. The BIG mainstream papers
that mentioned 80-20 include:

However, the best demonstration of 80-20's effectiveness emerged on 8/12. After 80-20's Exec. Comm. decided that it would express its displeasure publicly with the lack of response from the Bush camp, it sent to its 1.1 million subscribers a mass email entitled "Bush & Elaine Chao Don't Care About AsAms." Two days later, a prominent national conservative weekly magazine that is well-identified with the Republican Party, The National Review, reacted.

On 8/12, the magazine carried a 1500 word article devoted ALMOST EXCLUSIVELY TO 80-20. Its title is "If You're API and You Know It...vote Democratic?" Quoting 80-20 extensively, it hinted that 80-20 was a front for the Democratic Party. The article predicts that 80-20 will not be able to deliver 80-20 to Kerry, but might at best deliver 60-40. Go

80-20 is NOT a front for anyone. However, IF 80-20 endorses Kerry, though it has NOT, it shall deliver 80 to 20 for Kerry! If Bush wants our votes, he'll have to deliver two BIG ITEMS: 1) enforce Exec. Order 11246 for Asian Ams immediately, and 2) ease Congressman
Howard Coble out of the chairmanship of House Subcomm. On Homeland Security. 80-20 helps those who help AsAm's legitimate aspirations. 80-20 is always true to its words.

Bush & Elaine Chao Don't Care About AsAms

The NOBLEST of all American dreams is the dream of equal opportunity for ALL Americans. Thus far, AsAms have been denied that dream. Ample statistics show that we have been denied equal opportunity in workplaces. We are given less pay for equal work and 1/3 the opportunity of all other Americans to rise to the top.

Kerry and Nader want to include AsAms in that dream. BUSH DOES NOT.

BUSH HAS NOT, after repeated prompting by the leadership of 80-20** and many of you who sent faxes and emails.

Bush is the sitting president. He doesn't have to wait till after the election to open the opportunity for us. He could order Labor Secretary ELAINE CHAO to enforce EO 11246 for us NOW.

ELAINE CHAO doesn't have to wait for Bush to order her. Since 1965, the law has empowered the Labor Secretary to enforce EO 11246 for ALL Americans. What is the use of having an AsAm in the cabinet, if she doesn't have the integrity to enforce an existing law to protect AsAms from being discriminated in the workplace? See FOOTNOTE for evidence of non-enforcement.

After 4 years of quiet and diplomatic effort to get President Bush and Secretary Chao to open opportunity for AsAms & getting no action**, 80-20 must express utter disappointment in President Bush's Administration.

We urge all AsAms to tell their friends and relatives about the irresponsible policy decisions of those two individuals. 80-20 IS NOW CONSIDERING INITIATING A CLASS ACTION AGAINST THE U.S. LABOR DEPARTMENT.

After this public condemnation of the Bush Administration, if it still fails to respond BEFORE Nov. 2, then vote against Bush on that day.

Politics is funny, however. Sometimes, when politicians' mistakes are called to attention openly, they correct themselves. If and when that is the case, 80-20 will RECONSIDER its current position. However, AsAms will be foolish not to take Bush's non-response at its face value.

Condemn the Bush Administration's failure to respond to our legitimate concerns, and be psychologically prepared to vote against him in November.

FOOTNOTE: Let's look at the statistics in universities, the so- called
bastion of idealism in our society. University
administrators are recruited almost exclusively from the ranks
of faculty and professionals already employed in the academic
world. Hence the ratio of [administrators / (faculty +
professionals)], broken down to races, is a measure of the
opportunity enjoyed by American citizens of different races.
For full-time staff nationwide, that ratio for blacks (non-
Hispanic) is 0.193. That is, for every 100 black faculty and
professionals there are 19 black administrators. The ratio for
Native American is 0.169; for white (non-Hispanic) is 0.157; and
for Hispanic is 0.145. The national average is 0.150. The ratios
for men/women are rrespectively 0.15. However, it is only
0.057 for Asian American. The only group that has a lower
number is the "resident aliens," whose ratio is 0.046.

The situation is other US enterprises is worse!

Regardless of how Bush and Elaine Chao may defend themselves in
reaction to this e-mail, evidence will show that EO 11246 has
NEVER been enforced for AsAms. CIRCULATE THIS MESSAGE TO
YOUR FRIENDS AND RELATIVES.

When EO11246 is enforced, in 10 years there will be an increase of 6500 AsAm administrators in universities alone. When all domestic institutions are taken into account, the enforcement will benefit about 1 million AsAms directly. The ripple effect will benefit all AsAms greatly.

An AP article says shame on Asian Americans

Associated Press sent out an article entitled " Unlike Hispanics,
Surging Asian Population Lacks Political Clout ." Although it didn't say "Shame on Asian Americans, " to me it certainly implied it.

Hopefully, APAs will recognize that our lack of political clout
is a shame on us. Lacking political clout is a big reason why
a law, EO 11246, that is supposed to break the glass ceiling for all
Americans was NEVER enforced for APAs. It means that we failed to secure equal opportunity for our children.

How come we are so impotent?

Here are some reasons. Our focus on personal benefits rather than
community benefits is one reason. For example, our rich people give tens of thousands of dollars for a handshake or a photo with a famous politician or a possible later appointment rather than to APA political organizations. Even our political activists have focused on their respective turf concerns rather than APA unity, the bedrock of political clout. Another reason is that our support for politicians foolishly depends on their titles and likelihood to win the next election, NOT by how much they have served our community. In other words, we might have been too selfish for our own good.

80-20 is normally positive and optimistic. However, every once in a while we need to look at our own shortcomings in order to build a brighter future.

A Community Without 80-20 to Serve You

What if 80-20 vanishes from our community? Just consider the loss of two of the its current projects:

(2) Breaking the Glass Ceiling for the Working AsAms

Everyone talks about the glass ceiling. How many organizations have done something to BREAK the glass ceiling for YOU.

In the 2000 election, 80-20 requested in writing to presidential candidates for the historic first AsianAm cabinet member. Our political system responded. There have been 3 cabinet positions since. However, only our elite have benefited through that effort.

Differences & Similarities of Dem. & Rep.

ELECTION TIME. 'Tis an opportune time for AsAms.

Astute Americans use elections to get the 2 parties to do things for them. AsAms must learn to do the same. But, first, know the differences and similarities of the two parties, highlighting those features that are of particular relevance to AsAms.

SIMILARITIES:

o Both want our money & votes BEFORE elections & give back benign negligence AFTERWARDS.

o For example, both the Democratic & Republican Administrations didn't bother to enforce Exec. Order 11246 for AsAms, a law that was designed to give equal opportunity in workplaces for ALL Americans. We are the only Americans who were left out.

o Both competed to distance from the ENTIRE AsAm community during the campaign finance scandal of 1997, which New York Times termed the Asia Gate, although only a FEW AsAms committed the misdeeds.

o Both lust to win the White House. Both will serve our rightful interests, if WE CAN HELP THEM WIN the White house -- 80-20's reason in advocating a SWING bloc vote.

o Both want to do the right things for America, but both mostly place their partisan interests first. Hence each party MUST FIRST serve those of its constituents who demand service from them. If AsAms are dumb enough not to ask for their service, and/or if our votes & money are split 50/50, then both parties will forever feed us
benign neglect. Wake up! [See below for "constituents" of each party.]

DIFFERENCES
(Being brief, the following is not comprehens ive)

o Rep. and Dem. have different constituents.
The Republican Party mostly counts on votes from the white male, rural folks, folks down South and in the Mid-West, & conservatives (people who prefer to preserve things the old way).
The Democratic Party mostly counts on folks in big cities, African Ams., Hispanics, immigrants, union households, and liberals (people who believe in change in order to cope).

o The two parties are different in philosophy.
Everything else being about equal, GOP will favor the businesses, because it believes that a big profit for business will trickle down to benefit all Americans. Everything else being about equal, the Dem. Party will favor the working folks, not because it is more compassionate, but because most of its constituents happen to be the little folks.

Above all, REMEMBER that political parties act in their own interest. If we have the unity to deliver a SWING bloc vote, then the two parties will compete to serve our rightful interest in order to win our bloc vote in the NEXT election.

John Kerry, the Dem. Presidential candidate, has answered YES/YES/YES to 80-20's questionnaire on 12/22/03. Candidate George Bush has not, 100 days later. Is Bush always going to be slower than Kerry in responding to our rightful aspirations?

On 1/19/04, Bush-Cheney headquarters wrote 80-20 saying that it might reply in March. March has come and gone.

80-20's questionnaire seeks his promise that upon his becoming our next president, he will enforce Exec. Order 11246 for us, a law that is already enforced for all Americans except for APAs. When enforced, the number of APA Executive/Administrators/Managers/ Senior Partners are estimated to increase 3 fold within 10 years. Why is a bloc vote so powerful?

Why is a bloc vote so powerful? Here is an illustration.

Two candidates run against each other in a hypothetical political district that has two constituent groups only. One group has 1 million voters and the other has 10 million voters. Candidate A, a novice, eagerly focuses on the large group, not being aware that the small constituent group has the internal political cohesion to deliver a bloc vote while the large group does not.

Candidate A wins the endorsement of most community leaders in the large group. When the ballots are open, he indeed wins in the large community. He wins 52% of that community's votes, while his opponent gets 48%. The difference between 52% and 48% is 4%. The large group has 10 millions votes. 4% of 10 million votes provides a "profit" of 400,000 votes to candidate A.

His opponent, candidate B, is a seasoned politician. She courts the small group and wins that little community by a ratio of 80 to 20, the namesake of The 80-20 Initiative. The difference between 80% and 20% is 60%. 60% of 1 million votes provides a "PROFIT" of 600,000 votes.

As a result, candidate B wins the election by 200,000 votes. That is the POWER OF A BLOC VOTE.

In California, the APA population is 1/9 that of the rest of the population, similar to the example given above.
