Q1 Who will benefit?

When AsAm's chance to rise to the top equals that of the national
average, then

(a) In "private industries," 130,500 ADDITIONAL AsAms will
be promoted to "officials and managers". An additional 1.8
million will benefit knowing that they will enjoy equal
opportunity to rise to the top starting from then on.
(b) In "universities," 4889 additional AsAms will be promoted to
administrators; 70,000 will benefit in future chance for
promotions.
(c) In the Fed. Gov. 240 additional AsAms will be promoted to the
SES rank; 80,000 will benefit in future chance of promotions.

Another 11 million AsAms will benefit indirectly because a rising tide

NO, not at all! Exec. Order 11246 specifically states that the
enforcement of EO 11246 is the responsibility of the Labor Department, which
is under the administration of Sec. Chao. So if we want EO 11234 enforced
on our behalf, we must communicate with or appeal to Sec. Chao.

As a public servant, she has the OBLIGATION to
EITHER point out 80-20 is in error in its understanding of the government
data OR go to bat for AsAms by enforcing EO 11246.

Q4 Was it racism that has caused the following statistics?

Race is not the issue. Any group in America that doesn't have the
"group political clout" has gotten, is getting and will get discriminated.
That was evident in American history in the treatment of the Irish, Polish,
and Italians when they first immigrated to the USA. That was also clear in
seeing how Jews, women, African Americans, gays, & Hispanics were treated
then and now. Our lack of GROUP political clout is why we suffered and
still suffer discrimination!

Winning Equal Opportunity (1)

Dear Fellow Asian Americans:

Here is the striking information about the glass ceiling over us. 80-
20 has FORMALLY presented the information, established after months of
intensive studies, to Labor Secretary Elaine Chao. YOU MUST READ IT. If we
want to enjoy EQUAL OPPORTUNITY, we must ALL work on it. 80-20 by itself is
NOT strong enough.

2.1 million AsAms work for "private industries," or "universities" or
"the Federal government," as defined by the Fed. Government. They have the
WORST chance to rise to the top, when compared with Whites, Blacks,
Hispanics, Native Americans, and women. Here is what 80-20 has reported to
Sec. Chao and asked for help:

exact data used, and the simple calculations which lead to the conclusions

After 3 months, Sec. Chao has not replied. Perhaps, her office is
carefully studying the information provided to her. We are certain that
Sec. Chao knows that she has the OBLIGATION to either point out why 80-20 is
wrong or go to bat for the millions of AsAms using Executive Order 11246.

What is Executive Order 11246? Here is an exact quote from a 2003
Department of Labor document (Pam. OFCCP 7), entitled "Three Decades of
Commitment To Nondiscrimination & Equal Employment Opportunity"

"Executive Order 11246, as amended
This order, signed by President Lyndon B. Johnson
in 1965, prohibits discrimination in hiring or
employment opportunities on the basis of race, color,
gender, religion, and national origin. It applies to all
contractors and subcontractor holding any federally
assisted contracts worth more then $10,000.

In addition, the Executive Order requires contractors
and subcontractors with a contract of $50,000 or
more, and 50 or more employees, to develop a written
affirmative action program, that sets forth specific and
result-oriented procedures to which a contractor
commit itself to apply every good faith effort. "

Updating You; Announcements

1) On the Supreme Court Justice (SCJ) Front:

80-20 was aware of the immense implications of a NEW SCJ early!
Since 10/2004, 80-20 has plugged for an AsAm SCJ. Hence, once there
was a vacancy, many media and elected officials contacted 80-20
regarding qualified AsAm candidates for SCJ. 80-20 did a lot of raising
of internal and external awareness of the benefits of an AsAm SCJ.
Since there was only one vacancy, the odds for an AsAm SCJ were not
great. However, 80-20 will keep a keen lookout & seize every
opportunity to win EQUAL JUSTICE for the 13 million AsAms. Please
do your share.

2) Our Earlier Announcement to AsAm IEEE Members Led to Success!

James M. Tien, an 80-20 Life Member, wanted to run for IEEE President
again, since he was narrowly defeated the last time. So he wanted
IEEE members to petition for him. 80-20 announced his petition site.
He got 3000 petitioners owing to various efforts. As a result, he will
be on the ballot for 2006 IEEE President-Elect. Hopefully, he'll make
history and help break the glass ceiling. Find out more at

3) New Announcement On "US-China Cultural Engagement Act"

80-20 is pleased to honor a request by Board Member Jerry Xiangzhong
Yang to announce a site where you may sign an open letter to support
the "US-China Cultural Exchange Act." The Act was introduced by
Senators Lieberman (D-CT) and Alexander (R-TN), and is now
Senate Bill 1117. "The bill aims to provide $1.3 billion to greatly
enhance Chinese-language education in K-12 schools; expand the
exchange of artists, scientists, and students, particularly young
students, between the two countries; and promote scholarly studies on

Next Supreme Court Justice an Asian Am?


Fellow Asian Americans, aim high! Be bold! Help achieve a
common vision!

Supreme Court Justice Sandra O'Conner has just resigned.
President Bush could nominate a replacement as early as mid-July.
Could he be nominating the FIRST EVER ASIAN AM. candidate?

Not likely in this round. But it's not impossible, especially
if Chief Justice Rehnquist resigns also and President Bush will be
sending TWO names to the Senate! In that case, Bush will likely
nominate one conservative and one moderate. Many highly qualified
AsAms jurists are ideal replacements.

Our qualified jurists include 2 Circuit Court Justices: Ronald S.
W. Lew and A. Wallace Tashima; and 7 District Court Judges:
Denny Chin, Anthony W. Ishii, George H. King, Dana Makoto,
Susan Oki Mollway, Dana Makoto Sabraw and Robert A.
Takasugi. 80-20 has provided you with their brief bios earlier. Get
to know them from your own contacts..

Learning from the past, we don't just want any AsAm in high
government positions. Such complacency could BACKFIRE! For an
AsAm supreme court justice, we want the equivalent of a Thurgood
Marshall, not a Clarence Thomas.

Having a good AsAm Supreme Court Justice will mean winning
equal justice for AsAms ONCE & FOR ALL. Why? Any gross injustice
can always be appealed to the Supreme Court. Recall that it was the
Supreme Court that OKed the internment of Japanese Ams during
WWII.

He is married to Mary-Christy Fisher. They have two children in
Emily J.Y. Koh and William H. W. Koh. From '81 to '82, he clerked for
Supreme Court Justice Harry A Blackmum whom he greatly admires.
Then he went into private practice briefly. From, '83 to '85 he worked
For Reagan Administration's Dept. of Justice as Attorney-Adviser. In
'83 he also joined the Yale faculty. From '98 to '01 he worked for
Clinton Administration's State Dept. as the Assistant Secretary for
Democracy, Human Rights and Labor. He is now the Dean of Yale Law
School. He was mentioned by the NY Times as a possible candidate for
the Supreme Court:

Anthony B. Ching #####
He is the first ever Solicitor General of Arizona for 12 years. In
Arizona, a Solicitor General is in charge of all civil cases in which the
State is a party, while the Attorney General is in charge of the criminal
cases. Anthony argued two cases in the US Supreme Court in Graham
v Richardson and Perez v Campbell (both in 1971). Coincidentally,
Justice Sandra O'Connor was a state senator in Arizona before being
appointed to the Supreme Court by Reagan.

o Abercrombie & Fitch C.O.O. Seth Johnson called S. B. Woo at his home to relate its decision to withdraw its 4 new lines of T-shirts that denigrated AsAms, within 4 hours of a suggestion by 80-20,
o The Nat'l Republican Comm. withdrew, within 24 hours, a TV ad that showed the USA being nuked by China. 80-20 was the ONLY AsAm org. that spoke up & demanded the ad's withdrawal.
o Acting alone again, 80-20 got 8 Democratic president candidates including Kerry & Edwards to answer YES/YES/YES in writing to promise enforcement of Executive Order 11246 to ensure equal opportunity in workplaces for AsAms, should they be elected.
o During the SARS hysteria, a NJ school district apologized and took other compensatory actions for turning AsAm teachers away from contracted work for fear of SARS, two days after S. B. Woo negotiated by phone with the school superintendent.
o After weeks of resistance to give satisfactory apologies, Seattle Times and 101.5FM of NJ gave satisfactory apologies 3 days after 80-20 joined other sister organizations in protests.
o 80-20 delivered two bloc votes in the last two presidential elections to the candidates it endorsed. More than any of the above, those bloc votes gave us the political clout that WILL WIN for us:

(1) Federal government enforcement of Executive Order 11246, &
(2) an Asian American Supreme Court Justice.

Serving YOU!

ANNOUNCEMENT: 80-20 has appointed 2 National Merit
Scholars to "Chancellor Chang-lin Tien Summer
Internship." They will both help recruit 80-20 members,
cutting their political teech in the real world of their own
community. Yvon Wang studies at Princeton and Jenny
Jiang at UC, Berkeley. They are role models -- serving their
own community to win equal opportunity & justice.

Can you face your children, if the following radio
conversation about YOU occurs in your hometown? .

On 101.5 FM in NJ, the following conversation took place. Two
guys, Craig Carton and Ray Rossi, were spreading anti-AsAm sentiment
centered upon a Korean-Am political candidate running for office in
Edison, NJ. Result? A listener called in (capitalization our own):

"Caller: Hi, I love you
Carton: Thank you.
Caller: You just said it all, the last couple of...callers, I guess
they don't know that they live in America & WE'RE BEING OVERRUN.
I had just moved out of Edison because of what has happened in the
past 10 years... ORIENTALS ARE ALL ALONG, THE WHOLE
COMPLETE ROUTE 27 AND INDIANS HAVE TAKEN OVER
EDISON IN NORTH AND ALL OVER.
Carton: DAMN ORIENTALS AND INDIANS.
Caller: I..I moved out..36 years I've lived in Edison
Carton: And what was the biggest problem you had with the
Orientals and the Indians ?
Caller: I can't handle them! THERE'S NO AM. PEOPLE ANYMORE.
Carton: Eh..
Caller: THEY ARE SHOVING US THE HELL OUT!
Carton: It's like you're a foreigner in your own country isn't it?
Caller: You go to own store and you can't even see American people,
you don't see our own kids, American kids, working in stores anymore...
Carton: Like the next time you see an American, you think you'll
probably hug him or high five him or something?
Caller: Oh, that's why where I moved too, that's all I have, thank
God for now anyways.
Carton: YEAH I'M WITH YOU... SHARON, WE'RE JUST THE
VOICE OF THE PEOPLE, & ai appreciate your call.

Carton: All right, you got it baby... I think the quote was DAMN
ORIENTALS AND INDIANS.* "

The NJ AsAm leaders rose to the challenge.&nbs p; They organized a
Large & effective coalition including working with a NY coalition, &
providing the talk transcript and the names of the sponsors of the
radio program. Nevertheless after 4 weeks of negotiations, the
station still refused to get the two guys to apologize on air.

80-20 NATIONAL STEPPED IN at the invitation of the NJ Coalition.

80-20 targeted 3 of the radio programs' largest advertisers and
asked their CEOs to stop their ads. In 2 days, two of the three
advertisers responded positively. On the 3rd day, the "two guys"
agreed to apologize on air. In addition, the station manager
agreed to take 4 other measures to prevent future reccurence.

away in your hometown radio stations? That is where 80-20

Helping APAs Get Appointed

Here is what 80-20 did to induce the Bush Administration to make the cabinet appointments. You will see how 80-20 goes out of its way to help APA Republican Leaders.

In mid-Dec., 2000, African and Hispanic Americans had been appointed
to cabinet positions. In contrast, APA Republican leaders were having
trouble even seeing relatively low-level staff people involved in the appointment
process.

Therefore, on 12/14/00, 80-20 decided to find a way to induce President
Bush to appoint an APA cabinet member . The task was given to S. B Woo.

In the next few days, S. B. called two noted Republican APA leaders,
Matt Fong and John Tsu, to coordinate efforts. Without reaching either,
he left messages offering to help.

Matt Fong called back. On that day, he and many other GOP APA
leaders were in Washington D.C. working on possible appointments.
S. B. asked how things were going for them. Matt said that the APA
GOP leaders were pooling their political assets to lobby for APA cabinet
and sub-cabinet appointments. He also stated that they were having
trouble getting to see the right people.

SB asked whom they wanted to see. Matt named two. One was
Andrew H. Card who was then the Chief of Staff of the Transition Team

(T.T.) headed by V. P. Cheney. Card later became Bush's Chief
of Staff. Another person was Clayton Johnson, III, Exec Director of T.T.
S. B. observed aloud that Card was not easy to get hold of. However,
not being able to see Johnson was NOT a good sign. Matt agreed.

SB then asked how 80-20 could be helpful to them? Matt expressed
the wish to generate public pressure to open the right doors. SB
promised to help create that pressure.

On 12/21/00, SB sent an e-mail to V.P.-elect Cheney who headed the Transition
Office. S. B. took the carrot approach, stating

" .... APAs as yet do not identify with either party; we are here ready for you to make a move to win us over. Asian Ams. reside mostly in CA, NY and NJ. These are states rich with electoral college votes that GOP could win in 2004. ...

I respectfully request that you consider appointing qualified Asian Pacific
Americans to policy-making positions in President Bush's Administration

On 12/27/00, not having heard back from Cheney, 80-20 went to its trump
card, sending an e-mail to its 230,000 supporters, urging them to send
e-mails to the Transition Team:

"Call for Action:

... APA political leaders in both parties are beginning to understand that 80-20's success induces both political parties to pay more attention to them -- a win-win
situation that is good for our community and our political leaders.

To illustrate, we request that YOU fax or e-mail Pres.-elect Bush urging him to include Asian American Republican leaders In his cabinet.

A simple statement will suffice: " Dear Pres.-elect Bush: I urge you to include Asian Americans in your cabinet appointments. Respectfully yours, (your name and address)"

A helping hand from us NOW to get our APA Republican leaders appointed is more powerful than statements in the future saying that 80-20 works for the benefit of our community and is NOT a front for the Democratic Party.

Although SB didn't ask the supporters to copy him in, hundreds of supporters
copied SB in while e-mailing President-elect Bush AND V.P.-elect Cheney.
80-20 estimated that at least 1000 e-mail went into the Transition Office

The next day, on 12/28/00, 80-20 used the tremendous and immediate response
from its supporters to lobby about 400 reporters to "call the Transition
Team to get its response" regarding the aspiration of the APA community.
80-20's e-mail said:

"Dear Media Friends:

Although 80-20's e-mail entitled "President Bush/.../Call for Action" has NOT yet reached 1/3 of its 430,000 supporters, a huge amount of e-mail form Asian Americans has apparently already poured into Bush's Transition Ofc. ....

Please consider calling the Transition Office to get its reaction to these e-mails from Asian Pacific Americans. Thank you.

THE NEXT DAY, ON 12/29/00, the transition office responded positively. For the first time V.P.-elect CHENEY CONTACTED NORM MINETA, a Democrat, and inquired about his interest to serve in the Bush administration.


Inducing the Bush Adm. to make that critical first appointment was extremely important. IT MEANT that 80-20, through its various channels, had convinced the GOP that winning APA votes in 2004 would be of strategic importance. Other appointments would logically follow. THE REST WAS HISTORY.


In addition, expect other significant APA appointments shortly before Nov., 2004.
A little humor shouldn't hurt politics. Prior to Mineta's appointment, many APA GOP leaders publicly blamed 80-20's endorsement of Gore as the reason why Bush had not appointed an APA cabinet member. Now that there are TWO APA cabinet officers, was it all to 80-20's credit? :-)


Of course, not! We all share the same goal, though using different approaches. There is NO REASON that APA Democrats, Republicans, Independents and 80-20's leadership can't work together, whenever feasible. Winning equal justice and opportunity for the APA community should be the ONLY agenda.


Readers may also want to note that most of the 80-20's leaders have no personal political ambition at all. Some have even announced publicly not to run for election or accept any government appointment.

Asian American Voters Bucked The National Voting Trend

President Bush did better against his opponent in 2004 than in 2000, nationally and in all race subgroups except for the Asian Americans, according to LA Times' national exit poll. Somehow, the Asian Americans bucked the national trend. See

The Latinos shifted towards Bush by 14 points; the Blacks by 9, the Jews by 7; & the Whites by 4*. However, Asian Americans shifted away from Bush by 5 points*, bucking the national trend. Why?

A Short, Final Message from 80-20 Before 11/02

In the final analysis, our political system encourages individuals to vote THEIR OWN INTERESTS. Hence, the reason that 80-20 urges all Asian Americans to vote as a bloc for Kerry is simple. Kerry May Appoint AsAm To Supreme Court/ + & - Reactions

[A] KERRY MAY APPOINT AN ASAM TO THE SUPREME COURT!!

Three days after 80-20 raised the Supreme Court Justices issue
worrying about a Supreme Court filled with Bush appointees, the NY
Times answered. A front page article on 10/22 says that Kerry may
appoint the first Asian American to the Supreme Court! See excerpt:

“With no vacancies on the court in more than a decade, there
is heightened expectation that the next president will have
one or more opportunities to choose justices and shape the
court for years to come.

Some people who could be considered for the Supreme Court,
according to interviews with several Democratic advisers:

Koh, a widely admired scholar who has worked in both
Democratic and Republican administrations, would be the

For Asian Americans (AsAms), there is a more threatening issue.
When Pres. Roosevelt ordered during WWII the internment of ALL
Japanese Ams in the continental USA, Fred Korematsu challenged the
order all the way up to the Supreme Court. The Supreme Court ruled
that he and ALL Japanese Ams. be interned while only those Italian
and German Ams. who were suspected of espionage were also
interned.

Remember, John Kerry and John Edwards condemned Cong.
Howard Coble, who justified internment. George Bush and Dick
Cheney did NOT. Now you know the importance of electing John
Kerry.

An 80-20 Member Registering Voters

The following account is by William Uy, a life member of 80-20 and a Republican Delegate to 80-20's Endorsement Convention, of his recent experience registering voters in Oakland, CA.

Dear 80-20 Supporters,

I thought that you would be interested in the results of our (my wife Jing and I) voter registration activity in Oakland Chinatown. Since we do not speak Cantonese, we were lucky that three senior high schoolers - who speak Cantonese - volunteered to help us.

In a total of 6.5 hours (in two days), we registered 128 voters (includes on-site registration and cards requested) – predominantly Chinese Americans. We were busy the moment we set up our registration table. 53 of those were registered on-site and 35 were FIRST TIME voters. Even though we have voter registration cards with Chinese instructions, there were some who
still needed help filling out the cards. We also helped those, who brought their actual ballots and do not know what to do, even though the ballots have both Chinese and English instructions.

I tell you! It was a truly very satisfying and patriotic work. This is specially so when you watched the excitement and determination of some frail, white hair senior housewives who were registering for the first time in their life – and they are for Kerry!

Party affiliation of those registered on site: 2 Republicans, 14 Democrats, 37 declined to state party affiliation. However, it is safe to assume that over 90% of the 128 voters are for Kerry – judging from their comments.

Attached are some pictures taken of our voter registration activity. Note that I have used 80-20 as the organizer of this activity.

We also conducted voter registration at our parish church, St. Ignatius, in Antioch. Only 3 came to register (all Democrats).

Why Go For Kerry? / Good news

Our "Hope & Fear " are what led us to Kerry.

First, MORE HOPE for winning equal opportunity in workplaces e.g. in getting raises, promotions and rising to the top.

Kerry & Edwards both promised in writing to enforce
Executive Order 11246 for Asian Americans. EO 11246
is a law that has been used to eliminate discrimination
in workplaces for ALL Americans except for Asian Ams.
Bush & Cheney REFUSED to promise.

Second, LESS FEAR of having our civil rights violated, if, God forbid, a war breaks out between the U.S. & an Asian nation, say North Korea.

Even the U.S. Commission on Civil Rights (with many Bush
appointees) reported that the Bush administration's civil rights

80-20 Endorses, with reservation, Sen. Kerry & Why

80-20's elected Delegates, composed of 1/3 Republicans, 1/3 Democrats and 1/3 Independents, unanimously voted to "endorse , with reservation, Senator John Kerry for President." Their reasons are seen in the press release appended at the end.

In spirit, the "endorsement with reservation" means the following. 80-20 sends a clear message to all politicians & political parties: "If you want AsAms' votes and money, you need to earn it. No more free lunch."

In pragmatic terms for Asian Americans, the "endorsement with reservation" means the following: 80-20 still STRONGLY recommends that AsAms vote for Kerry. However, the 80-20 National will not be going all out in applying its resources to campaign for Kerry. The National will divert part of its war chest for a lawsuit against the Department of Labor which will better serve our community's interest. However, we'll still be doing a lot for Senator Kerry**.

In summary, 80-20's decision achieves three goals. a) To let President Bush and the Republican Party know that if you don't help us, we don't help you. b) To let Senator Kerry and the Democratic Party know that you had helped us some and we'll help back some. c) To let both parties know that 80-20 has tremendous ability to deliver Asian Am. votes. If the two Parties don't believe it now, on election day they'll find out the 80-20's "endorsement with reservation" would increase Senator Kerry's current 7-point lead to at least 30 among Asian Am. voters. Imagine, what they could have gained, had they earned 80-20's FULL endorsement!

**80-20 National will still focus in a couple of contested states to try to win electoral votes for Senator Kerry. We'll still do TV and newspaper ads. The ads will still be in four languages: English, Korean, Vietnamese & Chinese. However, given the delay of two weeks in getting all such efforts started and the allocation of fewer resources, the amount of the buy and the length of air time will obviously not be as large.

80-20, a National cyberspace organization capable of reaching 70% of Asian American (AsAm) registered voters in 30 hours, announced today, with reservation, to endorse Senator John Kerry for President. This decision was unanimously made by 1/3 Republicans, 1/3 Independents, and 1/3 Democrats, 2 weeks after its Endorsement Convention in San Mateo voted to postpone a decision.

Senator Kerry was given the nod because, in comparison, he and the Democratic party are better than Bush and the Republican Party for the past 4 years. Here are the comparisons:

B) Kerry & Edwards sided with AsAms in condemning Congressman Howard Coble, Chair, House Subcommittee on Homeland Security. Coble stated in public on Feb. 4, 2003 that internment of Japanese Americans during WWII was for protecting Japanese Ams. AsAms would be most worried by that type of protection should there be a significant conflict between USA and an Asian nation. In contrast, Bush & Cheney were silent. See Kerry and Edward statements:

C) The Democratic Party's position on immigration policy and anti-hate crime policy is better for all minorities including AsAms.

80-20 will divert a part of its election war chest to its pending lawsuit against the Department of Labor for its non-enforcement of Executive Order 11246 for AsAms.
